FAQ: Why isn’t there a federal mandate?

Why isn’t there a federal mandate? [FAQ Date: April 1, 2013]
CDC has consistently recommended influenza immunization for HCPs for many years (see 2006 MMWR , FAQ Date: . 24, 2006/55[RR02]; 1-16. Influenza Vaccination of Health-Care Personnel  —  Recommendations of the Healthcare Infection Control Practices Advisory Committee (HICPAC) and the Advisory Committee on Immunization Practices (ACIP): http://www.cdc.gov/mmwr/preview/mmwrhtml/rr5502a1.htm?s_cid=rr5502a1_e

However, states maintain the primary responsibility and authority for healthcare policies within their borders.  In this context, the federal government is limited to recommending rather than requiring.  It would require congressional legislation to create a specific immunization mandate; this is unlikely at best.
